    Unconventional Lawmaking in the Law of the Sea explores the ways that actors operating at the international level develop standards of behaviour to regulate varied maritime activities beyond traditional lawmaking. Other than conventions and customary international law, there is a plethora of international agreements that influence international conduct. This 'soft law' or 'informal law' is now prolific in ocean governance, and so it is time to consider its significance for the law of the sea. This monograph brings together women law-of-the-sea scholars with expertise in specific areas of the law of the sea, as well as international law more generally. Informal lawmaking is examined in relation to ocean resources, maritime security, shipping and navigation, and the marine environment. In each instance, there are reflections on the diverse actors, processes, and outputs shaping the regulation of the oceans. The analyses in this book further consider what this activity means within the rules on the sources, formation, and interpretation of international law. The growing reliance on informal agreements to fill legal gaps provides quick responses to pressing matters. We must assess and understand these new forms of cooperation in order to influence existing treaties or customary international law. Unconventional Lawmaking in the Law of the Sea surveys the scope of informal lawmaking in the law of the sea and evaluates the significance of this activity for the UN Convention on the Law of the Sea, as well as for ocean governance more broadly, now and in the future.

    The Indonesian Constitution is an important text that governs the world’s third largest democracy. After decades of authoritarian rule, the post-1998 era was characterised by a series of deliberate amendments to the 1945 Constitution. The constitution-making process that took place from 1999-2002 introduced profound changes to the legal and political system, including an emphasis on judicial independence, a bill of rights and the introduction of a Constitutional Court. A culture of constitutional democracy in Indonesia has developed through the robust engagement of civil society and ongoing advocacy campaigns for law and justice by legal advocates. This volume explores an ongoing set of debates over the meaning and practice of constitutional democracy in Indonesia. This includes the powers of the legislature, the impact of decentralisation, the scope of rights and permissible limits on rights, the regulation of elections, the watchdog role of accountability agencies, the influence of religion and the role of the Constitutional Court. These legal and political issues are analysed in light of the social, political, and economic environment that has seen a decline in tolerance, freedom and respect for minorities, raising questions about the state of democracy in Indonesia. New demands for amendments to the Constitution and calls to revert to its original form may be a potential threat to constitutional democracy. This book covers major themes that animate Indonesia’s Constitution and is therefore a seminal text for scholars of comparative constitutional law and politics.

    The legal profession has undergone significant changes in the past few years. These have affected working structures and context within the profession, in turn affecting the wellbeing of individual practitioners. This book is the first to consider how these operate in practice and how they impact on the wellbeing of lawyers. This is significant because legal systems cannot operate without properly functioning lawyers. Changes considered include rapidly evolving technologies such as the internet, artificial intelligence and increasing digitisation, and innovations in legal practice. Such innovations include changes in the structures of law firms, changing requirements about whether lawyers must practice separately from other professions and changing employment practices in law firms. The Impact of Technology and Innovation on the Well-Being of the Legal Profession considers the impact of all of these developments on the legal profession. It begins with students and how their responses to questions about their attitudes to learning may provide clues as to why they and the professionals they become might be more vulnerable to depression and anxiety than the wider population. The analysis then extends to how both satisfaction and stress levels can be simultaneously high and the implications of this, considering the experiences of lawyers in private and public practice, as well as academics, and their responses to the interactions between all of these changes. Leading researchers assess the situation in Australia and the United Kingdom in these various domains, using empirical research as the foundation of the arguments put forth. Anyone who is interested in the future of the legal profession and the challenges currently faced as a consequence of the massive structural and environmental changes experienced should read this book.
